10-Year-Old Boy Admits to a Crime He Can't Be Charged For

In a heart-wrenching turn of events, a 10-year-old boy from South Texas shocked investigators by revealing that he had fatally shot a man two years ago for no apparent reason. Despite the chilling confession, state law prevents the child from facing charges due to his age at the time of the crime. The incident came to light as the boy was being questioned for allegedly threatening a classmate on a school bus last week, prompting a deeper investigation into his background.

The unidentified child, part of the Nixon-Smiley Consolidated Independent School District, recounted the events of January 18, 2022, when he took a pistol from his grandfather's truck and entered an RV where 32-year-old Brandon O'Quinn Rasberry resided in Nixon, Texas, around an hour east of San Antonio. The child admitted to shooting Rasberry once, resulting in his death, despite having no prior connection to the victim.


During the questioning, the child maintained that there was no specific motive behind the act, stating that he had never met Rasberry before and had simply seen him around the RV that day. The child denied being angry with Rasberry or having any personal vendetta against him, leaving investigators puzzled by the seemingly senseless nature of the crime.

On April 12, investigators were able to trace the murder weapon to a pawn shop in a nearby town and confirmed its connection to Rasberry's murder through ballistic evidence. However, the legal constraints dictated by the Texas Penal Code prevent the child from being charged in relation to the homicide, given that he was under the age of 10 at the time of the offense.

The revelation of the child's involvement in a serious crime that he cannot be held accountable for has left both law enforcement and the community grappling with the complexities of the situation. While the child has been charged for the recent threat against his classmate and is currently in juvenile detention awaiting legal proceedings, the inability to address the previous homicide underscores the challenging terrain of dealing with juvenile offenders and the limitations within the legal system.

The emotional toll of the tragedy extended to the victim's family, with Jonathan Fojtik, Rasberry's brother, describing his sibling as a loving individual willing to help others. The profound impact of this case serves as a poignant reminder of the far-reaching consequences and unresolved dilemmas that accompany juvenile crime and the quest for justice.
